These Terms and Conditions (“Terms”) govern your access to and use of the Hamlett mobile application (“Hamlett” or “the App”), developed and operated by Snowbox AS, organization number 929 379 454 (“Snowbox”, “we”, “our”, “us”). By registering an account or using the App, you agree to be bound by these Terms. If you do not agree, you may not use Hamlett.

1. The Service

Hamlett is a digital platform available on Android and iOS that enables neighbors in condominiums to rent out parking spaces to one another. The App matches available parking spaces with users in need of parking and provides tools for administrators to manage the system.

2. User Accounts

  • To use Hamlett, you must register an account with accurate and up-to-date information.
  • Users are responsible for maintaining the confidentiality of their login credentials and for all activity under their account.
  • Hamlett reserves the right to suspend or terminate accounts in case of misuse, fraudulent activity, or breach of these Terms.

3. Payments and Fees

We use your data to:

  • Payments between users are processed securely through Stripe, our payment provider.
  • Where applicable, Snowbox may charge service and transaction fees. The applicable fees will be displayed in the App. Snowbox may change these fees at any time without prior notice.
  • Users are responsible for any bank fees, taxes, or other charges that may apply.

Minimum Amounts

The App may require certain minimum payment amounts, for example, per booking or per hour. Snowbox may change these minimum amounts at any time without prior notice. If a condominium’s listed parking rate is below the new minimum, the rate will be automatically adjusted to meet the updated minimum.

4. Cancellations and Refunds

  • Bookings can be canceled by either the requester or the parking space owner(s) at any time before payment has been made.
  • Once a booking has been paid, only the requester (the person who booked the parking space) can cancel. In such cases, no refund will be issued. The requester bears the cost of the cancellation.
  • Snowbox is not responsible for disputes or refund claims between users.

5. User Responsibilities

  • Users are solely responsible for their own use of parking spaces, including compliance with applicable laws, housing association rules, and agreements with other users.
  • Snowbox does not guarantee the availability, quality, or suitability of parking spaces.
  • Any disputes between users (including cancellations, damages, or unpaid rent) must be resolved directly between the parties. Snowbox is not a party to such disputes.

6. Personal Data and Privacy

  • Your personal data is processed in accordance with our Privacy Policy
  • You may at any time request deletion of your personal data stored by Hamlett.
  • If you have created a Stripe account in Hamlett (for example, by registering your bank account to receive payouts), you are solely responsible for managing and deleting that Stripe account. Snowbox cannot access or delete user-owned Stripe accounts. Stripe accounts are owned and controlled entirely by the user.

7. Limitation of Liability

  • Hamlett is provided “as is” and “as available”. We do not guarantee uninterrupted availability or error-free operation.
  • Snowbox is not liable for:
    • user behavior, including unlawful rentals, misuse of parking spaces, or non-payment,
    • disputes between users,
    • damages to property or vehicles,
    • indirect losses, lost profits, or other consequential damages.

8. Force Majeure

Snowbox is not responsible for delays or failures caused by circumstances beyond our reasonable control, such as strikes, lockouts, pandemics, war, natural disasters, or interruptions in internet/telecommunication services.

9. Termination

You may stop using the App at any time by deleting your account. Snowbox may suspend or terminate access to the App if you breach these Terms or if continued operation of your account poses a risk to Hamlett, other users, or Snowbox.

10. Governing Law and Jurisdiction

These Terms are governed by Norwegian law. Any disputes that cannot be resolved amicably shall be settled by the courts of Norway, with Oslo District Court as the agreed legal venue.
